Luxcon Valley s.à.r.l-s (hereafter called “ICookForYou.Lu”) has developed an advertising intermediation platform which can be accessed from the website iCookForYou.Lu designed to contacting diners wishing to contract personal cook services.

These terms and conditions are intended to regulate access and terms of use of the platform. Please read these conditions. 

To register with an email address, you acknowledge that you have read and accepted the general conditions of use.

2. Definitions

In this document:

GTC: It means these Terms and Conditions of Use.

Personal Cook: It means the user who uses the platform to offer services personal cook in exchange for a price freely agreed between the parties (personal cook and diner).

Commensal: It means the user using the platform to request a personal cook and eventually hire the services of a personal cook, agreed between the parties.

Menu: It means the specific content of the offer of service personal cook, made by the personal cook at the diner in response to the request recorded by the latter through the Platform, and includes both concrete proposal menu as any messages shared Fellow diner with regard to the service offered.

Offer: It means the content of the provision of services offered freely and independently by the cook at the diner in response to a request, and includes both the menu and the messages exchanged between the personal cook and the diner.

Application: It means the request of a private cook service by a diner across the platform.

3. Registration on the platform and creating an account

3.1. Registration conditions in the Platform

Platform can only be used by people over 18 years. Registration is strictly prohibited on the platform by a minor. By accessing, using or registering on the Platform, you confirm and warrant that you are over 18 years.

3.2. Creating an account

The platform allows users to request and provide the delivery of personal cook services with the ultimate aim of confirming a reservation through the Platform. To request or offer these services, you need to register on the Platform as a user.

To register for the Platform, need to have read and accepted these Terms and Privacy Policy.

When creating your account, regardless of the method selected, you agree to provide truthful and accurate information, and update such information via your profile or sending a notification to ICookForYou.Lu, in order to ensure its relevance and accuracy for the entire duration your contractual relationship with ICookForYou.Lu.

If you sign up using an email, you agree to keep secret the password selected when creating your account no longer communicate it to anyone else. In case of loss or disclosure of your password, you must communicate to ICookForYou.Lu immediately. You are solely responsible for use of your account by third parties, unless you have expressly communicated to ICookForYou.Lu loss, fraudulent use by a third party, or disclosure of your password to a third party.

Remember not create or use, under your own identity or under the identity of a third party, no additional account set up initially.

3.3. check

ICookForYou.Lu may, for purposes of transparency, to improve the accuracy or prevention or detection of fraud, establish a system to verify some of the information provided in your profile. It is primarily those cases in which you enter your phone number or you provide us with an ID.

You acknowledge and agree that any reference in the Platform or Services to information “certified” or any similar term means only that a user has successfully completed the procedure of existing verification Platform or the Services to provide more User information with which you are considering sharing a Path. ICookForYou.Lu cannot guarantee the accuracy, reliability or validity of the information subject to the verification procedure.

4. Use of Services

4.1. Advertising Media

4.1.1. commensal

As Fellow diner, as long as you meet the conditions set out in these Terms of Service, you can request a service via the platform by entering the information on the service you require (date, location, type of cuisine, etc.) and giving you a registered user before you finish registering your application.

When you register your application, you will receive a notification email with your contact information as a user and password to access the platform. Once discharged, you can make appropriate use of the Platform, always with the sole purpose of booking a service through it.

4.2. Book a Service.

4.2.1. Booking procedure of a service

ICookForYou.Lu has established a system for booking online service ( “Reserve”) through the Platform.

In order to book a service through ICookForYou.Lu it is necessary that (1) the guest register an application on the platform, which is automatically derived by the Fellow diner location, (ii) at least we send your offer in response to this request and (iii) the Fellow diner pay through the Platform.

Once an Application and a specific offer exists, and both users have agreed on the terms of service, diners can book the same through the Platform paying the full amount set by the personal cook in your offer, using the means payment established in the Platform.

4.3. Evaluation system

4.3.1. Functioning

ICookForYou.Lu as Fellow diner encourages you to publish your ratings on our services enjoying a service contracted through the Platform.

4.3.2. Moderation

You acknowledge and agree that ICookForYou.Lu reserves the right to not post or to remove any valuation considers that its content violates the provisions of the GCU.

5. Financial Conditions

Access and registration on the platform and sending requests and offers, do not imply any cost. However, the reservation will be confirmed after the payment of a price, under the conditions described below.

5.1. Price

5.1.1. Specific conditions for Fellow diner

As a guest, you can book a service through the platform following the relevant booking process. Upon receipt of a reservation confirmation email from us a legally binding contract between diner and personal cook, subject to any terms and conditions agreed between the parties is formed. ICookForYou.Lu charged the price agreed by the parties at the time of booking.

If you book a service on behalf of several people and one of them is minor, you represent and warrant to be legally authorized to act on behalf of the child. Minors may only participate in a service if accompanied by an adult who takes responsibility for them.

6. Cancellation Policy

6.1. Terms of payment refund in case of cancellation

Cancellation of a service is subject to the following:

  • If the cancellation is made by the us, the guest will be refunded the total amount to be paid.
  • In case of cancellation by the Fellow diner:
    • If the guest cancels the Service with superior advance to 30 days
    • If the guest cancels the service with more than 7 days and less than 30 day’s notice before the time set for the service, the guest is entitled to reimbursement of 50% of the amount paid, which will be paid to us.
    • If the guest cancels the service with less advance 7 days before the time fixed for the service, there will be no refunds diners. We will receive the rate fixed in Service Offer ICookForYou.Lu and management fees will remain.

ICookForYou.Lu assess, at its discretion and according to available information, the legitimacy of claims for reimbursement.

6.2. Right of withdrawal

you have no right to withdrawal from the date of delivery of the booking confirmation, provided it is executed in full contract between you and ICookForYou.Lu, consisting of contact with another user.

7. behaviour of people who visit the Platform and Users

7.1. Commitment of all people visiting the Platform

You recognize to be solely responsible to respect all laws, regulations and obligations applicable to the use of the Platform.

  • (I) not to send ICookForYou.Lu (especially when creating or updating your account) or to other users of the platform false, misleading, malicious or fraudulent information;
  • (Ii) not speak or behave, or post any content on the platform that may be defamatory, libellous, obscene, vulgar, offensive, aggressive, unfair, violent, threatening, harassing, racist or xenophobic nature, which have sexual connotations , incites violence, discrimination or hatred, or that promotes activities or use of illegal substances or more generally that is contrary to the objectives of the Platform and can infringe ICookForYou.Lu or a third party, or which may be contrary to good morals;
  • (Iii) not to infringe the rights and not to damage the image of ICookForYou.Lu, especially with regard to their intellectual property rights;
  • (Iv) not open more than one account on the platform and do not open an account on behalf of a third party;
  • (V) attempt to circumvent the online booking system Platform, mainly trying to send to another user your contact information for booking off the shelf in order to avoid paying management fees;
  • (Vi) not to contact another user via the platform, for any other purpose than the definition of conditions of service private cook;
  • (Vii) not to accept or to pay off the platform;
  • (Viii) comply with these Terms and the Privacy Policy.

7.2. Diners commitments

When you use the platform as a commensal, you agree to:

  • (I) inform us any change or modification regarding the service conditions agreed on the platform;
  • (Ii) ensure that we can contact the registered phone number on your profile;
  • (Iii) communicate to iCookForYou.Lu, your identity card or any other document proving your identity;
  • (Iv) inform us of any relevant information I should know regarding movable and immovable property to be used / occupied during the service, especially in case of countertops, walls, glass, glass ceramics or any other susceptible equipment damage during execution of the service;
  • (V) facilitate the cook’s dishes, glassware, cutlery and other utensils necessary to perform the Service;
  • (Vi) wait for the Cook at least until 30 minutes after the agreed time.

In case you have made a reservation on behalf of third parties, you warrant that such party will respect the conditions set out in that Article and, in general, the GCU. ICookForYou.Lu reserves the right to suspend your account, limit your access to the Services or terminate the GCU in case of default by the third party on whose behalf you have booked the Service in accordance with these Terms of Service.

8. Suspension of accounts, access restriction and termination

You can cancel your contractual relationships with ICookForYou.Lu, at any time, for free and without having to explain why. To do this, simply go to the “My Account” section and select “Delete Account”.

In the case of (i) your breach of these Terms, including without limitation breach of your obligations as a user as set out in Articles 6 and 8 above, (ii) exceeding the limit set up in Article 4.3.3, or (iii) in the event iCookForYou.Lu have any real reason to believe that it is necessary to protect the safety and integrity of users or third parties, or for the purposes of fraud prevention or investigation, we reserve the right to:

  • (I) terminate the GTC that link you with us immediately and without notice; I
  • (Ii) avoid publishing or to remove any opinion, message, content, booking request or any content that you publish on the platform; I
  • (Iii) limit you access and use of the platform; I
  • (Iv) temporarily suspend or permanently your account.

In the case of (i) your breach of these Terms, including without limitation breach of your obligations as a user as set out in Articles 6 and 8 above, (ii) exceeding the limit set up in Article 4.3.3, or (iii) in the event iCookForYou.Lu have any real reason to believe that it is necessary to protect the safety and integrity of users or third parties, or for the purposes of fraud prevention or investigation, we reserve the right to.

9. Personal Data

In the context of the use of the Platform of you, ICookForYou.Lu collect and process your personal information. By using the Platform and register as a user, you acknowledge and accept the processing of your personal data by ICookForYou.Lu in accordance with applicable law and the provisions of the Privacy Policy.

10. Amendment of the GTC

These GTC and integrated by reference documents form the entire agreement between you and ICookForYou.Lu in relation to the use of the Platform. Any other document referred to in the platform (FAQ, for example), it is only indicative purposes.

ICookForYou.Lu may amend the GCU to adapt to technological and commercial environment, and to comply with the legislation. Any modifications to the GTC will be published in the Platform indicating the date of entry into force, and receive a notification of the change before the entry into force.

11. Applicable Law – Litigation

These GTC are written in English in accordance with Luxembourg Law.

If necessary, you can also submit your complaints regarding our Platform on the platform of online dispute resolution from the European Commission, which you can access from the link below. The European Commission will send your complaint to the competent national body. In compliance with the law applicable to the arbitration, you have an obligation before requesting arbitration ICookForYou.Lu communicate in writing any claims or litigation in order to obtain an amicable solution.
